Terms of Use

Welcome to TopDeals (the “Site”). These Terms of Use (“Terms”) form a binding agreement between you (“you”, “your”) and TopDeals  (“TopDeals”, “we”, “us”, “our”). By accessing or using the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Site.


1) Who we are & how to contact us

2) Changes to these Terms

We may update these Terms at any time by posting a new version on the Site. Changes apply from the “Last updated” date above. If a change materially affects your rights, we’ll take reasonable steps to notify you. Your continued use means you accept the changes.


3) Eligibility

You must be 18+ (or the age of legal capacity in your jurisdiction) to use the Site or place orders. If you use the Site on behalf of a business, you represent you have authority to bind that business.


4) Your account

  • You’re responsible for your account credentials and for all activity under your account.

  • Keep your password secure and notify us immediately of any unauthorised use.

  • We may suspend or terminate accounts for breach of these Terms or suspected fraud/abuse.


5) Products, pricing & availability

  • We aim to describe products, specs, and prices accurately. Errors may occur.

  • We may correct any error or omission and cancel orders affected by obvious pricing or stock mistakes, even after you submit an order (we’ll refund you if charged).

  • Prices are shown in USD (or ZIG/other currencies where indicated). Taxes, delivery, and fees are shown at checkout where applicable.

  • Promotions, coupons, and bundles have stated conditions and end dates; they can’t be combined unless explicitly allowed.


6) Orders & acceptance

  • Your order is an offer to buy. We accept your order when we send an Order Confirmation (email/SMS/onsite notice).

  • We may decline or cancel any order (e.g., due to stock limits, payment issues, delivery constraints, or compliance concerns).

  • We may request ID or additional verification for high-value orders or where fraud is suspected.


7) Payment

  • We accept the payment methods shown at checkout (e.g., cards, Paynow, bank transfer, mobile money, cash on delivery where offered).

  • By submitting a payment method, you confirm you’re authorised to use it and that the details are correct.

  • For bank transfer/RTGS/ZIPIT, orders may ship after funds clear.

  • If a payment fails or is reversed, you remain responsible for amounts due and any related costs.


8) Delivery, risk & title

  • We deliver to the areas shown at checkout, using our courier partners or in-house logistics. Estimated delivery times are estimates only.

  • Risk of loss passes to you upon delivery to your address or designated pickup point. Title passes upon our receipt of full payment.

  • You must provide accurate delivery details and ensure someone is available to receive goods. Redelivery or address changes may incur additional fees.

  • Inspect parcels on delivery; note any visible damage on the courier’s slip and inform us promptly.


9) Returns, refunds & exchanges

  • Our Returns Policy (linked on the Site) forms part of these Terms.

  • In general: return requests must be lodged within the stated window; items must be unused, in original packaging, with all accessories and proof of purchase.

  • Certain items can’t be returned (e.g., hygiene goods once opened, software activation keys, custom orders), unless faulty.

  • For faulty/incorrect items, we’ll repair, replace, or refund within a reasonable time as required by law.

  • Refunds are processed to the original payment method where possible. Processing times may vary by provider.


10) Warranties & after-sales support

  • Manufacturer warranties (if any) apply in addition to statutory rights.

  • Misuse, unauthorised repairs, liquid/impact damage, and normal wear are not covered.

  • Keep original packaging and documentation to facilitate warranty claims.


11) User content (reviews, comments, uploads)

  • You’re responsible for content you submit (reviews, Q&A, images). Don’t post anything unlawful, misleading, defamatory, obscene, infringing, or harmful.

  • You grant TopDeals a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display your submitted content for marketing, operation, and improvement of the Site.

  • We may moderate, edit, or remove content at our discretion.


12) Acceptable use & prohibited behaviour

Do not:

  • Break the law, infringe IP rights, or violate third-party privacy.

  • Scrape, crawl, or use bots without our prior written permission.

  • Interfere with Site security or attempt unauthorised access.

  • Post or transmit malware, spam, or deceptive content.

  • Abuse coupons, referrals, or promotions, or engage in fraudulent purchases/chargebacks.


13) Intellectual property

All Site content (text, graphics, logos, product data, code, and compilations) is owned by TopDeals or its licensors and protected by law. You may not copy, distribute, or create derivative works without our written consent, except for personal, non-commercial browsing of the Site.


14) Third-party links & services

The Site may link to third-party websites or use third-party services (payments, shipping, analytics). We’re not responsible for their content, policies, or practices. Your use of those services may be governed by their terms.


15) Privacy & cookies

Our Privacy Policy explains how we collect, use, and share your data, and how cookies and similar technologies operate. By using the Site, you consent to our data practices as described there.


16) Disclaimers

  • The Site is provided on an “as is” and “as available” basis. While we aim for accuracy and uptime, we do not guarantee the Site will be error-free or uninterrupted.

  • Except as expressly stated, TopDeals disclaims all warranties (express or implied), including fitness for purpose and non-infringement, to the maximum extent permitted by law.


17) Limitation of liability

To the fullest extent allowed by law, TopDeals and its directors, employees, and agents will not be liable for:

  • indirect, incidental, special, consequential, or punitive damages;

  • loss of profits, revenue, data, goodwill, or business interruption;

  • amounts exceeding the greater of (a) USD $100 or (b) the total paid by you for the product(s) giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited.


18) Indemnity

You agree to defend, indemnify, and hold harmless TopDeals from claims, damages, costs, and fees arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.


19) Force majeure

We are not liable for failure or delay caused by events beyond our reasonable control (e.g., acts of God, power or network outages, strikes, war, civil unrest, epidemics, transport disruptions, import restrictions).


20) Suspension & termination

We may suspend or terminate your access (with or without notice) if we reasonably believe you breached these Terms or for security, maintenance, or legal reasons. You may stop using the Site at any time.


21) Disputes, governing law & venue

These Terms are governed by the laws of Zimbabwe. You and TopDeals submit to the exclusive jurisdiction of the courts in Harare, Zimbabwe. Before filing a claim, both parties will attempt in good faith to resolve disputes within 14 days after written notice.

22) Notices

Legal notices to TopDeals must be sent by email to [email protected] and by hand/registered post to our registered office. We may provide notices to you via email, SMS, in-account messages, or on-Site banners.


23) Assignment

We may assign or transfer our rights and obligations under these Terms. You may not assign your rights without our prior written consent.


24) Severability, no waiver, entire agreement

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. These Terms, together with policies referenced here (e.g., Privacy Policy, Returns Policy), are the entire agreement between you and TopDeals regarding the Site.
